Welcome to Garden Vision. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.
1. Service Description
Garden Vision is an AI-powered mobile application that generates garden design visualizations and plant recommendations. The app is operated by TERRA EM INFO CONSULT SRL.
2. Acceptance of Terms
By using Garden Vision, you agree to these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use the app.
3. User Accounts
To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscriptions and Payments
Garden Vision offers the following plans:
- Free: 1 garden design with watermark, 5 styles, 3 chat messages per session
- Personal ($4.99/month): 20 designs/month, all 16 styles, no watermark, 10 chat messages per session
- Pro ($12.99/month): 60 designs/month, all 16 styles, no watermark, 30 chat messages per session, HD export
- Credit Packs: 10 designs for $1.99, 25 designs for $3.99
Annual subscriptions are available at a 33% discount. Subscriptions are managed through Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
5. User Content
You retain ownership of photos you upload to the app. By uploading a photo, you grant us a limited, non-exclusive license to process the image for the purpose of generating garden designs. We do not claim ownership of your photos or the AI-generated designs created from them.
6. AI-Generated Content
Garden designs, plant recommendations, and other content generated by AI are provided for inspirational and informational purposes only. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. Please refer to the Disclaimer in our Privacy Policy for detailed limitations.
7. Intellectual Property
The Garden Vision app, including its design, code, content, logos, and branding, is the intellectual property of TERRA EM INFO CONSULT SRL. You may not copy, modify, distribute, or reverse-engineer any part of the app without our written permission.
8. Prohibited Uses
You agree not to:
- Use the app for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Upload content that is illegal, harmful, or infringes on others' rights
- Use automated systems or bots to access the app
- Resell or redistribute AI-generated content as a competing service
9. Limitation of Liability
To the maximum extent permitted by law, TERRA EM INFO CONSULT SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes, but is not limited to, damages resulting from plant recommendations, garden designs, or any advice provided through the app.
10. Termination
We reserve the right to suspend or terminate your access to the app at any time for violation of these terms. You may delete your account at any time through the app settings.
11. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the new terms. We will notify users of significant changes through the app or via email.
12. Governing Law
These Terms of Service are governed by applicable EU law. Any disputes arising from these terms shall be resolved in accordance with applicable jurisdiction.
